Abstract

EL-RAKHAWI DOCTRINE OF THE SUPREME SYMBIOTIC COURT: EXECUTIVE SUMMARY This treatise establishes the definitive judicial architecture for the post-AGI era: the El-Rakhawi Supreme Symbiotic Court. Traditional legal systems are fundamentally inadequate to address algorithmic crimes and networked harm. This work proposes a revolutionary framework grounded in Karl Friston's Free Energy Principle, establishing neurological violence as measurable legal harm. We introduce the El-Rakhawi Cognitive Free Energy Index (ECFEI) as admissible scientific evidence, mandate reversed burden of proof in algorithmic cases, and design a tripartite structure: Neuro-Cognitive, Algorithmic Accountability, and Climate-Cognitive Rights chambers. Drawing lessons from eight historical international tribunals (Nuremberg, ICTY, ICTR, ICC, and others), we address geopolitical realities, financial architecture (450-600 million euros annually), defense rights, judicial accountability, and cultural pluralism. The doctrine pioneers restorative penalties including mandatory algorithmic open-sourcing and cognitive rehabilitation, alongside predictive preventive justice with strict epistemological safeguards. We anticipate future challenges: quantum computing, advanced generative AI, neuro-genetic manipulation, digital consciousness cloning, and third-generation neural interfaces. The Global Academy of Symbiotic Jurisprudence will train 500 judges and 5000 expert witnesses by 2040. Performance targets include 200 cases annually by Year 10, 20 percent global ECFEI reduction, and 90 percent compliance rate. Contingency plans address resistance from major powers, corporate non-compliance, technological outpacing, and geopolitical fragmentation. The Symbiotic Rome Statute should open for ratification by 2030, entering into force by 2035. This is not utopian fantasy but a civilizational imperative: the era of cognitive impunity must end.
