Distribuição dos recursos orçamentários: entre critérios técnicos e decisões políticas
Abstract
This article aims to examine the legal boundaries governing decisions concerning the allocation of public resources, particularly in light of the tension between technical-budgetary criteria and choices of a political nature. The analysis begins with the increasing emphasis on technocratic decision-making models, often presented as objective, neutral, and efficient mechanisms, in contrast to the choices made by political actors throughout the formulation and implementation of the public budget. Although economic indicators, cost estimates, expected benefits, and efficiency criteria constitute essential instruments for the proper management of public resources, the definition of public expenditures necessarily involves choices among competing priorities, rights, public policies, and constitutionally relevant objectives, thereby giving the allocation process an inseparable legal and political dimension. Within this context, the study examines the constitutional, statutory, and procedural requirements applicable to the submission and implementation of parliamentary budget amendments, comparing them with the recent approaches adopted by the Brazilian Federal Supreme Court and the Federal Court of Accounts. It seeks to determine the extent to which oversight bodies have established additional standards of transparency, traceability, justification, and accountability in the allocation of public funds, including requirements that are not expressly provided for in the 1988 Federal Constitution or in budgetary legislation. The research also investigates the potential effects of such oversight on the autonomy of the Legislative Branch, the separation of powers, and the constitutionally protected sphere of political decision-making in budgetary matters. Accordingly, the study examines the extent to which legal oversight may impose constraints on the process of selecting and distributing public resources without replacing the legitimate political judgment entrusted to democratically elected representatives. The research adopts a legal-dogmatic and bibliographical approach, drawing on the Federal Constitution, relevant legislation, procedural rules governing parliamentary amendments, audit reports and decisions issued by the Federal Court of Accounts, as well as rulings of the Brazilian Federal Supreme Court concerning the subject. Ultimately, the article seeks to contribute to defining the boundaries between political discretion, technical rationality, and legal oversight in the formulation and implementation of the public budget.
