Abstract
This research analyzes the crime of fuel oil (BBM) fraud in Pangandaran Regency under Ciamis District Court Decision Number 45/Pid.Sus/2025/PN Cms from the perspectives of Indonesian positive law and Islamic criminal jurisprudence (fiqh jinayah). Employing a qualitative-normative method with juridical content analysis, this paper examines the illicit mixing of 200 liters of Pertamax with 800 liters of low-grade condensed oil ('putihan') and chemical dye. The findings demonstrate that the judges convicted the defendants based on courtroom facts, confessions, expert witness testimonies, and Lemigas laboratory testing verifying sub-standard fuel quality. The conduct satisfied the elements of Article 54 of Law No. 22 of 2001 in conjunction with Article 55 paragraph (1) of the Criminal Code (joint perpetration/medeplegen). Under Islamic criminal jurisprudence, this unlawful act constitutes jarimah ta'zir encompassing elements of tadlis (deception), ghisy (fraudulent trade adulteration), and syirkah fi al-jarimah (criminal conspiracy). The proportionate penal sanctions imposed upon Defendant I (field operator) and Defendant II (intellectual mastermind) align with the Islamic legal maxim of al-mubasyir wa al-mutasabbib and the objectives of Islamic law (maqashid al-shari'ah) in safeguarding wealth (hifzh al-mal) and eliminating public harm (dar'ul mafasid).
