Sep 2026 · International journal of social science and human research · 0 citations

Abstract

Advancements in information technology have driven a shift from conventional to electronic transactions, offering convenience and efficiency but also introducing risks such as fraud, breach of contract, misuse of personal data, and non-conformity of goods or services. This study aims to analyze consumer legal protection, business actor liability, and dispute resolution mechanisms in electronic transactions under the Electronic Information and Transactions (ITE) Law. It employs a normative legal research method utilizing statutory and conceptual approaches. The findings indicate that consumer protection is not solely based on the ITE Law but must be interpreted in conjunction with the Consumer Protection Law, the Government Regulation on Trade Through Electronic Systems, and the Personal Data Protection Law. Such protection encompasses legal certainty in electronic transactions, consumer rights, business actor liability, system and personal data security, and dispute resolution mechanisms involving both non-litigation and litigation channels. Consequently, an integrated legal protection framework is essential to ensure security, certainty, and fairness for consumers in electronic transactions.
