Abstract

This study examined the legal challenges facing land planning laws in controlling urban and peri-urban areas in Tanzania. The study was motivated by the continued existence of unplanned settlements, weak development control, institutional challenges and difficulties in managing rapid urban expansion despite the presence of legal frameworks governing land planning. The study intended to assess the adequacy of land planning laws, analyse the legal challenges affecting their implementation and enforcement, compare Tanzania’s legal framework with selected jurisdictions, and propose legal reforms for improving effective land planning control. The study employed doctrinal and comparative legal research methodologies by analysing primary legal materials, including legislation and judicial decisions, together with secondary sources such as books, journal articles and policy documents. The study found that the major challenges affecting land planning include weak enforcement mechanisms, overlapping institutional responsibilities, inadequate responses to peri-urban growth and limited integration between formal planning systems and existing land practices. The study concluded that the problem is not mainly the absence of laws but weaknesses in the implementation and coordination of the existing legal framework. It recommended strengthening enforcement mechanisms, improving institutional coordination, developing responsive planning approaches and enhancing accountability in land planning processes.
