The Legal Status of Smart Contracts and Blockchain Technology in Contemporary Commercial Transactions
Abstract
The rapid advancement of blockchain technology and smart contracts has significantly transformed contemporary commercial transactions by introducing decentralized, transparent, and automated mechanisms for executing contractual obligations. Blockchain technology provides a secure, distributed ledger system that records transactions in an immutable and verifiable manner, while smart contracts are self-executing digital agreements programmed to perform contractual obligations automatically once predetermined conditions are satisfied. These innovations have enhanced efficiency, reduced transaction costs, minimized reliance on intermediaries, and improved transparency across sectors such as banking, finance, insurance, supply chain management, intellectual property, healthcare, and international trade. Despite these benefits, the increasing adoption of blockchain-based commercial transactions has generated complex legal challenges concerning contract formation, enforceability, jurisdiction, liability, consumer protection, privacy, cybersecurity, dispute resolution, and regulatory compliance.
