Using artificial intelligence to improve the effectiveness of civil justice: opportunities and limits

Abstract

The main approaches regarding the use of artificial intelligence in civil proceedings, both in the courts of general jurisdiction of the Russian Federation and in foreign countries, have been examined. The application of artificial intelligence technologies by courts is considered as one of the ways to enhance the efficiency of civil proceedings. The aim of the study is to identify promising directions for the development of civil procedural legislation and judicial practice in the field of artificial intelligence technology application, as well as to determine the boundaries of such use. In this regard, an assessment of the specified measure was conducted in terms of meeting two efficiency conditions: achieving the goal of justice in civil cases and optimizing (minimizing) litigation costs. Taking these conditions into account, possible directions for the use of modern technologies in civil proceedings have been identified, ensuring a genuine increase in the efficiency of judicial proceedings. It is concluded that, with the obvious effect of reducing (optimizing) litigation costs to enhance the efficiency of civil justice, the use of artificial intelligence should ensure the achievement of the goal of civil proceedings – the protection of the rights, freedoms, and legitimate interests of individuals seeking judicial protection.
